WHD to Hold Employer and Worker Forums to Solicit Feedback on A Future Rulemaking Regulating Independent Contractor Status

The U.S. Department of Labor’s (DOL) Wage and Hour Division (WHD) announced that, in light of a March 14, 2022 district court ruling vacating DOL’s rules to delay and withdraw the Trump-era independent contractor rule, WHD plans to engage in a rulemaking on determining employee or independent contractor status under the Fair Labor Standards Act (FLSA).

As part of the rulemaking process, the WHD plans to hold public forums this month to hear diverse perspectives from those who may be affected by employee or independent contractor classification. The forums will be split into two categories, one for employers and one for workers. The Employer Forum will be held on June 24, 2022 from 2:30pm to 4:30pm ET.
