WHD Finalizes Delay of Independent Contractor Final Rule until May 7

In accordance with President Biden’s regulatory freeze memo issued on Inauguration Day, the Department of Labor’s Wage and Hour Division (WHD) issued a notice which will appear in tomorrow’s Federal Register to finalize the Biden administration’s delay of the effective date for the Trump administration’s independent contractor rule until May 7, 2021. The rule was set to take effect on March 8, 2021.

SWACCA has been working with the Biden administration to implement this delay and submitted formal comments to the WHD, setting up the legal and policy justifications for this delay. Per this notice, WHD states that the delay will allow the Department to review issues of law, policy, and fact raised by the rule before it takes effect.
