White House Completes Review of Final Rule Rescinding Joint Employer Rule, Publication Imminent

The White House Office of Information and Regulatory Affairs (OIRA) has concluded its review of the Department of Labor’s final rule to rescind the Trump Administration’s rule regulating joint employer status under the Fair Labor Standards Act, signaling that publication of the final rule in the Federal Register is imminent. SWACCA has advocated against the prior Administration’s joint employer rule since it was first proposed in 2019. Most recently, SWACCA led an effort to draft and submit comments in April with our allies in the Construction Employers of America in support of the Department of Labor’s proposed rescission of the joint employer rule.
