Senate Passes Congressional Review Act Resolution to Rescind SWACCA-Supported Joint Employer Rule but President Biden Vows to Veto
Last night, the Senate voted 50-48 to pass H.J. Res. 98, a Congressional Review Act resolution to nullify the National Labor Relations Board’s SWACCA-supported joint employer final rule. This final rule rescinds the previous Administration’s joint employer rule and implements a new standard for determining joint employer status under the National Labor Relations Act to help reduce employee misclassification in the construction industry.
The Senate vote followed a vote on the CRA resolution in the House on January 12, 2024, which passed by a vote of 206-177. The CRA resolution now heads to President Joe Biden, who vowed on January 8, 2024 to veto this legislation and preserve SWACCA’s regulatory victory.
