House and Senate Lawmakers Reintroduce the SWACCA-Opposed “Save Local Business Act”

This morning, Sen. Roger Marshall (R-KS) and Rep. James Comer (R-KY) reintroduced the “Save Local Business Act” (S. 1261/H.R. 2826). This legislation would amend the National Labor Relations Act and the Fair Labor Standards Act to substantially curtail the instances when a company may be deemed a joint employer in relation to the employees of another entity, like a subcontractor, such that it would almost never be liable for misclassification of the subcontractor’s workers as independent contractors or other serious violations of federal employment laws.

SWACCA has consistently opposed and helped to defeat the “Save Local Business Act” in previous Congresses and most recently sent letters opposing this bill in the 117th Congress in May 2021 that are available here.
