Pennsylvania Worker Misclassification Task Force Releases Report with Recommendations to Prevent Misclassification for General Assembly

The Commonwealth of Pennsylvania has released a new Task Force Report estimating that almost 50,000 Pennsylvania employers are misclassifying workers as independent contractors and making recommendations to address the problem, including the expansion of a state law that currently applies to the construction industry, adoption of a uniform test to differentiate employees versus independent contractors, and stiffer penalties for employers that misclassify workers.

In its report, the Task Force highlights that “misclassification harms everyone except the lawbreakers,” noting that “law-abiding businesses lose out on business and contracts to unscrupulous businesses engaged in knowing and rampant misclassification.”
