House Oversight Republicans Request Briefing from Biden Administration on Development of FAR Council’s Project Labor Agreement Proposed Rule

Republicans on the House Committee on Oversight and Accountability sent a letter to the Biden Administration requesting documents and information related to the Federal Acquisition Regulatory (FAR) Council’s rulemaking to implement President Biden’s Executive Order (E.O.) on Project Labor Agreements (PLAs) that would require PLAs in all federal construction projects worth $35 million or more. SWACCA submitted three sets of comments in October 2022 in support of the FAR Council’s PLA proposed rule.

In the letter, the lawmakers say that the E.O. “threatens to raise taxpayer costs, cut non-union workers out of federal projects, and force right-to-work states to freeze local workers out of cooperative federal projects.” The letter requests the Biden Administration provide a briefing by May 31, 2023 to Oversight Committee staff that includes information on how the committee’s concerns about the impact of E.O. were considered during development of the FAR Council’s rulemaking.
