NLRB GC Issues Memo on Strengthening Inter-Agency Enforcement in Response to White House Worker Organizing and Empowerment Report

NLRB General Counsel Jennifer Abruzzo issued a memorandum to all field offices committing to work closely with other federal agencies to fully effectuate the National Labor Relations Act (NLRA). In the memo, GC Abruzzo embraces recommendations outlined in the recent White House Task Force on Worker Organizing and Empowerment report.

To effectuate these recommendations, Abruzzo details plans to strengthen partnerships with other agencies, including: (1) coordinating with the IRS, the FTC, and the DOJ’s Antitrust Division to address unfair methods of competition that undermine workers’ rights, with a focus on reducing employee misclassification, ensuring employers pay employment taxes, creating mechanisms for sharing data about acquisitions, mergers or similar actions that may detrimentally affect organizing or bargaining efforts, and giving greater attention to non-disclosure, non-solicitation, and non-compete agreements that harm fair competition and violate employees’ rights under Section 7 of the NLRA; (2) partnering with the Department of Labor and the EEOC to establish a regular series of webinars focusing on combatting retaliation; and (3) supporting the Homeland Security’s recently revised worksite immigration enforcement policy and committing to work closely with DHS to ensure all immigrant workers are able to freely and fully exercise their labor rights.
