HUD Proposes Phased Implementation Waiver for Build America, Buy America Requirements for Construction Materials Used on HUD-Assisted Projects

The U.S. Department of Housing and Urban Development (HUD) proposed a public interest waiver timeline to further HUD’s phased implementation of the Buy America preference for construction materials applied to recipients of HUD federal financial assistance (FFA).

Specifically, HUD is now proposing an updated implementation timeline across its FFA programs. For Community Development Block Grant formula grants, and beyond iron and steel products used in infrastructure projects, the Buy America preference will be implemented as follows: (1) in Fiscal Year (FY) 2024 for non-ferrous metals, lumber, composite building materials, plastic and polymer-based pipe and tube (collectively referred to as the “specified construction materials”); (2) in FY 2025 for other construction materials; and (3) in FY 2025 for manufactured products. For Choice Neighborhood, Lead Hazard Reduction, and Healthy Homes Production Grants, the Buy America preference will be implemented as follows: (1) on February 22, 2023 for iron and steel; and (2) on August 23, 2024 for construction materials (including the specified construction materials) and manufactured products. For Recovery Housing Program Grants, the Buy America preference will be implemented as follows: (1) on August 23, 2023 for iron and steel; (2) in FY 2024 for the specified construction materials; and (3) in FY 2025 for all other construction materials and manufactured products.  For HOME, Housing Trust Fund, and Public Housing FFA used for maintenance projects, the Buy America preference will be implemented as of August 23, 2024 for iron and steel, construction materials (including the specified construction materials), and manufactured products. Finally, for all other HUD FFA, the Buy America preference will be implemented as follows: (1) on February 22, 2024 for iron and steel; and (2) on August 23, 2024 for construction materials (including the specified construction materials) and manufactured products.
