OMB Issues First Guidance Document Regarding Implementation of the Bipartisan Infrastructure Law

The Biden Administration released a Fact Sheet to highlight the release of initial guidance from the Office of Management and Budget regarding implementation of the Bipartisan Infrastructure Law passed last November.

The initial implementation guidance directs federal agencies to ensure accountable stewardship of funding under the Bipartisan Infrastructure Law. Specifically, the guidance includes direction on: (1) the use of data and evidence in implementing the Bipartisan Infrastructure Law; (2) planning for program implementation; (3) properly documenting selection criteria and review processes; and (4) reporting on grant awards and subawards. 

The guidance also requires federal agencies to collaborate with agency Inspector Generals to hold joint program review meetings and identify and mitigate risks during program design, including putting in place financial management controls to address payment integrity risks.

Finally, guidance also includes direction on: (1) collaborating with state, local, Tribal, and territorial governments to help them access infrastructure funding; (2) providing technical assistance to underserved and capacity-strained communities to help them access federal resources; and (3) engaging with affected communities so their perspectives and expertise inform policy development, program design, and delivery processes.
