DOL Wage and Hour Division Publishes Guidance on Enforcing Protections for Employees to Pump Breast Milk at Work

The Department of Labor’s Wage & Hour Division published Field Assistance Bulletin (FAB) No. 2023-2, on “Enforcement of Protections for Employees to Pump Breast Milk at Work.” This bulletin provides guidance for employers, workers, and Labor Department enforcement staff regarding the application of new requirements from the Providing Urgent Maternal Protections for Nursing Mothers (PUMP) Act that took effect on December 29, 2022. The law provides most employees the right to reasonable break time and a private space while at work to express breast milk for a nursing child for up to one year after the child’s birth and requires employers to follow posting requirements, break time and space requirements, as well as other protections for nursing mothers.
