WHD and NLRB Sign Memorandum to Enhance Information Sharing, Enforcement, Training, and Outreach

The Department of Labor (DOL) and the National Labor Relations Board (NLRB) announced that DOL’s Wage and Hour Division and the NLRB have signed a Memorandum of Understanding strengthening the agencies’ partnership and outlining procedures on information-sharing, joint investigations, and enforcement activity, as well as training, education and community outreach. Specifically, the memorandum notes that:

“DOL/WHD and NLRB may share, whether upon request or upon an agency’s own initiative, any information or data that supports each agency’s enforcement mandates, whether obtained in the course of an investigation or through any other sources to the extent permitted by law. This may include complaint referrals and other sharing of information in complaint or investigative files relating to alleged violations of the laws enforced by DOL/WHD and NLRB.”

DOL highlights that the agreement is an effort by DOL and NLRB to improve the enforcement process of the laws they administer. In addition to enhanced enforcement, the agencies will use the partnership to increase the public’s understanding of the laws enforced by the Wage and Hour Division and the NLRB through increased community outreach, shared compliance materials, joint presentations and training events.
