Civil Rights Commission’s California Advisory Committee to Hold Meetings to Discuss California’s AB-5 Law Regulating Independent Contractor Status

The U.S. Commission on Civil Rights announced five public meetings (through three separate notices here, here, and here) of the California Advisory Committee between August 2023 and December 2023 to review and discuss the latest draft of its report on the civil rights implications of California’s AB-5 independent contractor law that went into effect on January 1, 2020.

AB-5 established a new legal standard for companies to determine under California law if workers are independent contractors or if they should be classified as employees. The AB-5 standard required many companies to reclassify independent contractors as employees entitled to labor protections such as minimum wage laws, sick leave, and unemployment and workers’ compensation benefits, which do not apply to independent contractors. The passage of California Proposition 22 in 2020 overrode AB-5 as far as app-based drivers for companies like Uber and Lyft were concerned.
