In today’s Federal Register, U.S. Citizenship and Immigration Services (USCIS) announced that it is automatically extending the validity of Temporary Protected Status (TPS)-related documentation for beneficiaries under the TPS designations of El Salvador, Nicaragua, Honduras, Haiti, Sudan, and Nepal from December 31, 2022 to June 30, 2024. The TPS-related documents covered by this notice are Employment Authorization Documents, Notices of Action (Forms I-797), and Arrival/Departure Records (Forms I-94).

TPS is a temporary immigration status granted to eligible nationals of a country under the Immigration and Nationality Act or to eligible persons without nationality who last habitually resided in the designated country. During the TPS designation period, TPS beneficiaries are eligible to remain in the United States and may obtain work authorization so long as they continue to meet the TPS requirements.

According to USCIS, this notice ensures the agency’s continued compliance with various court orders issued by federal district courts in the Ramos and Bhattarai lawsuits that require USCIS to maintain the TPS designations for El Salvador, Nicaragua, Honduras, Haiti, Sudan, and Nepal, as well as the TPS and TPS-related documentation for eligible affected beneficiaries. These extensions allow TPS beneficiaries to maintain TPS through June 30, 2024 provided that the affected beneficiaries remain individually eligible for TPS.
