Final Text of Rule to Expand Use of PLAs Under Review at the White House

Overnight Thursday, the Federal Acquisition Regulatory Council transmitted to the White House Office of Information and Regulatory Affairs final text of its SWACCA-supported rule to implement President Biden’s February 2022 Executive Order directing federal agencies to make greater use of Project Labor Agreements (PLAs) on construction contracts expected to cost $35 million or more.

SWACCA was involved in multiple comment letters on this rulemaking and has been advocating for expanded use of PLAs since the beginning of the Biden Administration. SWACCA’s advocacy team has been engaged throughout the regulatory process on this issue and has been pressing the Administration to finalize the regulation in the face of strong opposition from some members of the U.S. Senate and the U.S. House of Representatives, as well as their allies in the non-union construction industry.  Review by the Office of Information and Regulatory Affairs (OIRA) is the last phase of the regulatory process prior to a final rule publishing in the Federal Register
