OFCCP Publishes ICR to Reinstate Form Used to Collect Information on Employee Work Hours by Race, Gender, and Trade

The Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) is seeking comments on the proposed reinstatement of an information collection request regarding the Monthly Employment Utilization Report (CC-257).

The CC-257 is a form that covered construction contractors previously submitted to OFCCP on a monthly basis with information on employee work hours by race/ethnicity, gender, and trade in the covered area. With the proposed reinstatement of Form CC-257, construction contractors will again provide information on employee work hours and employee count by race/ethnicity, gender, and trade in the covered area. OFCCP will use this information collection to strengthen enforcement and oversight in its construction program by using the collected information to inform compliance assistance efforts and track the progress of contractor’s outreach efforts and the agency’s Megaproject Program. The Megaproject Program, created under the Bipartisan Infrastructure Law, fosters equal opportunity in the construction trades workforce of federal contractors and subcontractors on large federal construction projects. The collected information will also improve OFCCP’s scheduling of compliance evaluations of covered construction contractors, as the reports will provide relevant information on which projects are currently active and current employee counts.

Comments are due by April 23, 2024 and can be submitted to the federal eRulemaking portal.
