House Passes Resolution to Rescind the NLRB’s Joint Employer Rule that Would Help to Reduce Employee Misclassification

This morning, the House voted 206-177 in favor of a Congressional Review Act (CRA) resolution that would rescind the SWACCA-supported National Labor Relations Board’s final joint employer rule. This final rule rescinds the previous Administration’s joint employer rule and implements a new standard for determining joint employer status under the National Labor Relations Act to help reduce employee misclassification in the construction industry.

The CRA resolution now heads to the Senate, where moderate Democratic Sen. Joe Manchin (D-WV) is a co-sponsor and a handful of other Democrats have expressed support. If the Senate passes the CRA resolution, it will then be sent to President Joe Biden, who has vowed to veto the resolution.
