House Republicans Introduce CRA to Overturn SWACCA-Supported Davis-Bacon Final Rule

Rep. Lloyd Smucker (R-PA), along with 19 of his Republican colleagues including House Education and the Workforce Chair Virginia Foxx (R-NC), introduced a Congressional Review Act (CRA) resolution to overturn the U.S. Department of Labor’s (DOL) SWACCA-supported Davis-Bacon Modernization final rule that went into effect on October 23, 2023. The CRA process allows Congress to nullify “major” rules issued by federal agencies if a majority of lawmakers in the House and Senate pass a CRA resolution by a simple majority and the President signs it.

As discussed during SWACCA’s October Membership Meeting in Boston, SWACCA’s public policy team anticipated the introduction of a CRA resolution to overturn the Davis-Bacon rule and has been laying the groundwork to oppose the resolution since the final rule was originally published in August. This includes our work with our allies to secure a letter of support for the Davis-Bacon rule on September 6, 2023—two weeks after the final rule was published—from 13 House Republicans. With the slim, four-seat majority in the House, the early support from these Republican lawmakers will be critical to ensuring the defeat of this CRA resolution.
