FTC Commissioner Bedoya Cites SWACCA Congressional Testimony In Calling for Federal Fair Competition Laws to Be Used to Address Unfair Advantage from Misclassifying Workers As Independent Contractors

Last Friday, Federal Trade Commission (FTC) Commissioner Alvaro Bedoya gave a speech entitled “Overawed”: Worker Misclassification as a Potential Unfair Method of Competition” in which he focused on the need to use federal fair competition laws, like the Federal Trade Commission Act, to address “the competitive disadvantage that honest businesses face when they go against businesses that misclassify.” 

In his carefully researched remarks, Commissioner Bedoya cited, among other sources, SWACCA’s 2019 congressional testimony on the impact that worker misclassification has on honest employers in the construction industry. In his remarks, Commissioner Bedoya speaks extensively on unfair competition in the construction industry by means of worker misclassification.
