Federal Judge in Philadelphia Refuses to Block FTC Ban on Non-Compete Agreements
U.S. District Judge Kelley Hodge, a Biden appointee, refused to enjoin the Federal Trade Commission’s (FTC) final rule banning non-compete agreements. In her ruling, Judge Hodge disagreed with a federal district court in Texas’s decision earlier this month enjoining the FTC from enforcing the rule against a coalition of business groups including the U.S. Chamber of Commerce, and Ryan Tax Firm. Judge Hodge reasoned that the FTC has the power to ban practices that it deems anticompetitive, including the use of non-compete agreements that curb competition for labor.
