Judge Extends Pause of Biden Administration Program to Provide Green Cards and Work Authorizations to the Undocumented Spouses of U.S. Citizens

Judge J. Campbell Barker of the U.S. District Court for the Eastern District of Texas extended the pause on the Biden Administration’s “Keeping Families Together” program that provides parole in place, work authorization, and a green card for undocumented immigrants with U.S. citizen spouses until September 23, 2024. In his ruling, Barker rejected arguments from the Department of Homeland Security that his original administrative stay issued on August 27, 2024 was improper because the Republican states suing over the program lacked standing. Under the pause, DHS can continue to accept new parole applications, but it may not issue new parole grants.
