Virginia Lawmakers Pass Legislation to Address Worker Misclassification and Employer Retaliation

This week, the Virginia House of Delegates gave final approval to legislation (H.B. 1407) that would require the Virginia Department of Taxation to investigate and impose monetary penalties against employers who misclassify their workers. The bill would impose a fine of up to $1,000 per misclassified worker, with higher penalties for repeat violations.  

In a separate vote, the Virginia House passed an additional bill (S.B. 662) that would punish employers who retaliate against their workers who report misclassification issues to state authorities. Both of these measures are being sent to Governor Ralph Northam (D-VA) for his signature.
