DOL Issues Updated Q&A Document Providing Additional Guidance Regarding The Families First Coronavirus Response Act

The Department of Labor (DOL) has updated its Q&A document regarding the Families First Coronavirus Response Act (FFCRA) to add five new questions and answers (numbered 89 – 93).  These new questions include FAQ 92 addressing the fact that employers cannot require an employee to provide documentation or similar certification that he or she sought a diagnosis or treatment from a health care provider in order for the employee to use paid sick leave for COVID-19 related symptoms; and FAQ 93 addressing the fact that employees may not take FFCRA leave to care for their children merely because their school is closed for summer vacation, or any other reason that is not related to COVID-19.
