SWACCA Joins CEA In Filing Comments on DOL Independent Contractor Proposed Rule

In addition to filing its own substantive comments, SWACCA joined its allies in the Construction Employers of America (CEA) to file comments on the Department of Labor’s proposed rule regarding independent contractor status under the Fair Labor Standards Act.

In its letter, the CEA notes its opposition to the proposed rule and says that, if implemented, the proposed rule would provide a more lenient framework compared to current case law and state laws, thus making it easier for employers to misclassify workers as independent contractors. The letter goes on to say that this would result in misclassified workers being denied wage and hour protections and make them ineligible for employer-sponsored health insurance.
