Biden Spokesperson Cites Independent Contractor Rule in Discussing Plans to Halt Trump-Era “Midnight Regulations” on Inauguration Day

A spokesperson for the Biden Transition team announced today that President-elect Biden will issue a memorandum on Inauguration Day freezing “midnight regulations” issued in the final days of the Trump Administration. Biden spokesperson Jen Psaki cited the Department of Labor’s independent contractor rule that SWACCA submitted comments in opposition to as an example of a “midnight regulation” the Biden Administration would seek to freeze. Psaki said the memorandum would take effect on January 20th and apply to any agency rules or guidance issued by the Trump Administration that are not final and effective by Inauguration Day.
